Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Outcast application and related services (the "Service"), operated by Axis Maps ("Axis Maps", "we", "us" or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Outcast is a workout-scheduling application that helps you plan recurring workouts. With your permission, it reads your Google Calendar availability to avoid conflicts, and optionally uses local weather forecasts to schedule outdoor workouts at favourable times. It can send you email reminders, web-push notifications, and provide a subscribable calendar (ICS) feed of your scheduled workouts.
The Service is provided to help you plan and organise physical activity. It does not provide medical, fitness, or health advice.
2. Eligibility and accounts
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
You access the Service by signing in with a Google account. You are responsible for maintaining the security of your Google account and for all activity that occurs under your Outcast account. Notify us promptly at dave@axismaps.com if you suspect any unauthorised use.
3. Health and safety disclaimer
The Service is not a substitute for professional medical or fitness advice. You are solely responsible for your own health and safety when exercising. Consult a qualified healthcare professional before beginning any new exercise programme, and stop and seek help if you feel unwell. Weather forecasts and scheduling suggestions are provided for convenience only and may be inaccurate; always use your own judgement before exercising outdoors. You exercise at your own risk.
4. Third-party services
The Service integrates with third-party services, including Google (authentication and calendar availability), WeatherAPI.com (weather forecasts), Resend (email delivery), and our hosting and database providers. Your use of those integrations may also be subject to the third parties' own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services, and your authorisation of any integration is at your discretion. You may revoke Google Calendar access at any time through your Google Account settings.
5. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- attempt to gain unauthorised access to the Service, other users' accounts, or our systems;
- interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure;
- probe, scan, or test the vulnerability of the Service, or circumvent any security or authentication measures;
- reverse engineer, decompile, or attempt to extract source code, except to the extent permitted by law;
- use automated means to access the Service in a manner that sends more requests than a human could reasonably produce, except for the intended use of the calendar (ICS) feed; or
- resell, sublicense, or commercially exploit the Service without our prior written permission.
We may suspend or terminate access for violations of these Terms.
6. Your content and data
You retain ownership of the data you provide, such as your workout preferences and location. You grant us a limited licence to process that data solely to operate and provide the Service. Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.
7. Intellectual property
The Service, including its software, design, and branding, is owned by Axis Maps and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms. No other rights are granted.
8. Availability and changes
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service is offered on an evolving basis, and we may add, modify, suspend, or discontinue features at any time. We may also perform maintenance that temporarily limits availability.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that scheduling suggestions, calendar availability checks, or weather forecasts will be accurate, complete, or suitable for your circumstances.
10. Limitation of liability
To the fullest extent permitted by law, Axis Maps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Subject to the foregoing, our total aggregate liability arising out of or relating to the Service shall not exceed the greater of the amount you paid us (if any) in the twelve months preceding the claim, or £50.
11. Indemnity
You agree to indemnify and hold harmless Axis Maps from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your breach of these Terms, to the extent permitted by applicable law and except where such claims arise from our own negligence or wrongful conduct.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. On termination, the licences granted to you end, and we will handle your data as described in the Privacy Policy. Sections that by their nature should survive termination (including Sections 6, 7, 9, 10, and 11) will continue to apply.
13. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except that if you are a consumer resident in the EU or elsewhere, you may benefit from any mandatory protections and the jurisdiction of the courts of your country of residence under your local law.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Service or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
